Complaints and/or Questions: 
If you wish to complain and/or have any questions about our products or service you can email, phone or post. We aim to respond to complaints and/or questions within 5 working days. If for any reason we are unable to resolve a complaint and/or respond to your question we will inform you of this.

Customer Privacy:
 We will ask you for information such as your name and email address. This is necessary for you to become a registered customer and so that we can fulfil your orders. We keep a record of your purchases so that we can email you about relevant offers and deal with returns efficiently. We also keep a record of any correspondence you send us, as this helps us keep track of any problems, concerns or suggestions. In addition to processing your orders, your contact details may be used for our own marketing purposes; we may send or email you brochures and leaflets, or email you about promotional offers, to discuss previous orders, or for market research purposes. We respect the privacy of your personal data, and will comply with all relevant and current data protection legislation, including the Data Protection Act 1998. We will never pass your email address on to a 3rd party for marketing purposes or another company. Your privacy is paramount.

To fulfil our obligations to the Buyer, we will communicate with you by email. The Buyer agrees to receive communications from us electronically and that electronic communications will satisfy any legal requirement for communications to be in writing.
From time to time, we will send you information by email about Cornish Magpie. If you do not wish to receive these emails, please contact us and let us know.

Product(s) and Packaging:
Product(s) and packaging are subject to change without prior notice. If a product(s) is out of stock we will contact you with a choice of replacements, the option to cancel the whole order or remove that product(s) if part of a larger order, or arrange a later delivery date with the original chosen products, if this is possible.
We have made every effort to display the colours, specifications and dimensions of items on the Website as accurately as possible. The colours you see will depend on the resolution of your monitor. We cannot guarantee that your monitor's display of any colour will reflect accurately the colour of the item delivered. We may from time to time vary the dimensions, specifications and quantities of items displayed on our Website without prior notice.

 All relevant products have a full list of ingredients. Should you require a full list of ingredients of a product before making a purchase, please contact us and we will be happy to provide you with this.

Cornish Magpie are not currently VAT registered and prices quoted are not therefore liable to VAT.

Trade Orders: 
Cornish Magpie is a retail outlet only and does not deal with trade orders.

"Buyer" means the individual or the organization who buys or agrees to buy the Goods from the Seller.
"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977.
"Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions.
"Goods" means the articles that the Buyer agrees to buy from the Seller.
"Seller" means Cornish Magpie, 7 Furry Way,  Helston,  Cornwall  TR13 8SN that owns and operates www.cornishmagpie.co.uk
"Terms and conditions" means the terms and conditions of sale set out in this agreement, and any special terms and conditions agreed in writing between the Seller and the Buyer.
"Website" means www.cornishmagpie.co.uk

Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.
These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

Ordering: All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions, and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
Where the Goods ordered by the Buyer are not available from stock, the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 30 days.
By ordering, you are providing details which are true, accurate, current and complete, and that the payment details are correct and your own.
You will be sent a confirmation email of your order, summarizing the details, either by Cornish Magpie via Paypal or by Cornish Magpie itself, depending on the method of payment for your order. This is the point at which we accept your order and the contract is formed.

How to Order:
 You can place an order with Cornish Magpie online, by phone or by post. We are unable to accept orders from persons whose billing/own address contains a PO Box Number. We will however deliver to a PO Box Number.
Online:- You can place an order online at any time. Simply add the items you wish to buy to your basket and check out using our Paypal service. You do not require a Paypal account to use this service - all major debit and credit cards are accepted.
By Phone:- You can place an order over the phone between the hours of 9:00am - 8:00pm, 7 days a week.  If the line is busy or there is no answer, please leave your name and contact number and we will phone you back as soon as possible.  All calls are charged at your service provider's rates. We do not currently take credit card orders over the phone, but once an order has been placed, we accept cheques through the post for the order.
Please ensure you have the following information ready when ordering:
 Name and billing address, telephone number (daytime) and email address, in case we need to contact you regarding your order.
Items you have selected. We require the product(s)  and the quantity required to process your order. You may wish to shop online but instead of proceeding to checkout simply print out your basket and use this when ordering over the phone.
Delivery address. Orders can be delivered to the address of the person ordering, the home address of the recipient receiving the goods or delivered to a place of work.
Post:- To order by post. Please select your items using the website and print out your completed basket, including your details (see above - as per ordering by phone) and post to our correspondence address: Cornish Magpie, 7 Furry Way,  Helston,  Cornwall TR13 8SN.  Please ensure your details are written in BLOCK CAPITALS.
We always advise phoning us prior to posting an order to ensure goods are in stock.
Your order will not be dispatched until the cheque has been received and has cleared. Please ensure your cheque card number is written on the reverse of your cheque.

Price and Payment: 
Products are invoiced in GBP sterling at the price prevailing at the time the Buyer places an order.
The price of the Goods shall be that stipulated on the Website. There is no applicable VAT. The quoted price excludes any delivery charges.
The total purchase price, and delivery charges (if any), will be displayed in the Buyer's shopping cart prior to confirming the order.
After the order is received, the Seller shall confirm by email the details, description and price for the goods.
Payment of the price plus any delivery charges must be made in full prior to the dispatch of the Goods.
Credit Card:- We accept payments online via Paypal, which accepts payments via a Paypal account and also via all major debit and credit cards.
The name and billing address given must be the same as that registered with your card supplier. Please ensure the details you provide are correct because all orders are credit card sanctioned before dispatch. Cornish Magpie will not be liable for an order being delayed due to incorrect or invalid payment details being given. Your order, if incorrect details are supplied, will be held back until the correct details are given. We will advise you either by e-mail, phone or post if incorrect details have been provided.
Cheques:- We accept payment by cheque made payable to "Cornish Magpie". The order will not be dispatched until the cheque has been received and clears the bank.

Order Confirmation:
 Your order will confirmed via email with your order number. Keep this safe in case there is a problem with your order, please quote this number when contacting us.

Returns and Cancellations: 
Items damaged in transit - if the Buyer takes delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you, provided you return the damaged item(s) to us within 30 days of taking delivery.
Defective items - the Buyer has the right to return faulty items within 28 days along with proof of purchase.
Cornish Magpie takes care to ensure your order is dispatched in perfect condition. If your order arrives damaged you must advise us within 7 days. As a consumer this does not affect your statutory rights. If the Buyer fails to do so, the Buyer shall be deemed to have accepted the Goods.
Where a claim of defect or damage is made, the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are, in fact, defective.
Incorrect items - if you have been sent an incorrect item, please contact us immediately or within 28 days and return the incorrect item to us, and specify the correct details in writing. If you would like us to replace the incorrect item with the item you ordered, we will send you the correct item as soon as possible. Alternatively, we will refund the item once it has been returned. We will not charge you for the incorrect item. We must have the incorrect items returned to us.
Dissatisfaction - Cornish Magpie takes care to ensure your order is dispatched in perfect condition. If you are not entirely happy with the product(s) you must advise us within 7 days. As a consumer this does not affect your statutory rights. If the Buyer fails to do so, the Buyer shall be deemed to have accepted the Goods.
Cancellations - you may cancel your order up to 24 hours before the day of dispatch. Most orders are dispatched within 2 working days. As orders are processed as soon as possible, it may not always be possible to prevent an order from being dispatched. If your order has already been dispatched, you may return the items to us in accordance with our policies below. If you wish to cancel your order, please contact Cornish Magpie by phone on 07709 534 788 and ensure you quote your order number. 
You may also cancel your order at any time without reason in accordance with the Distance Selling Directive (2000) within 7 working days of receipt of the Goods, starting on the day after the day on which the item is delivered to you. This right applies to all items advertised on the Website except for perishable goods and sealed items where the seal has been broken. A full refund, including any P&P paid will be made within 28 days of cancellation. You must confirm this in writing and return the packaged item(s) to our correspondence address: Cornish Magpie, 7 Furry Way,  Helston,  Cornwall TR13 8SN. We request all items are returned at the customers cost. A refund can only be provided for items received back by us, please ensure that you obtain proof of postage.
Returns - if you wish to return any item(s) please contact us prior to posting the item(s). There may be occasions when it is not necessary to inconvenience you in returning an item(s). Goods must be returned by the Buyer and the Buyer's expense and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (including any P&P charges) except for return postal charges, within 30 days of cancellation and on receipt of the returned goods by the Seller.
Costs - please return any incorrect or faulty items to us, and we will replace or refund you for the item upon receiving the returned goods. Until you return items to us, you are responsible for their safe keeping and taking reasonable care of them. We do not accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.
Goods being returned must have the order number obtained from the Seller clearly shown inside the package.
Where returned Goods are found to be damaged due to the Buyer's fault, the Buyer will be liable for the cost of remedying such damage.

Cornish Magpie posts orders to addresses in the U.K. mainland and Northern Ireland using Royal Mail.
For heavier or bulkier parcels, we also use a courier service. Please contact us for details of this courier service.
*Some items are excluded from our "FREE P&P to any UK address for orders over £50.00". Please see individual item descriptions or contact us for details.

Delivery Areas:
We will deliver to any address; private, work, BFPO or PO Box Numbers in the U.K. mainland and Northern Ireland using Royal Mail or courier service.

We aim to dispatch all orders within 2 working days.
Goods supplied outside of the UK will normally be delivered within 10 working days of acceptance of order.
Please ensure that the recipient of the order will be able to accept the delivery.
We will deliver to the address as you entered it and cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. We accept no liability or provide a refund if delivery is not made due to the recipient not being available. We use third party companies for delivering your order and cannot be held responsible for late deliveries due to postal strikes, transport strikes or incidents, adverse weather conditions or any other incident or reason that is out of our control.
If you have selected for your order to be delivered to a work address, Cornish Magpie shall be deemed to have delivered the order to its intended recipient, delivering it to the reception area at that business address. If sent by courier a signed receipt of delivery will be obtained from a representative at that business address. No record of receipt will be obtained when items are sent by Royal Mail.

Delivery Rates:
 Delivery is free for all orders of £50 and over. Delivery is charged on orders under £50. The Royal Mail service does not guarantee delivery on a specific date and no signature will be obtained from the recipient.

Courier Service: 
We also use a courier service for heavy or bulky parcels. Please contact us for details of this courier service.

Orders From Outside of the UK:
 Cornish Magpie welcomes orders from outside of the UK. We request please that the Buyer contacts us by phone on +44 07709 534 788 or by email at [email protected] to check on postal charges for any order.
Customers who choose to purchase items for use outside the UK do so at their own risk, and have a personal responsibility regarding compliance with local laws.
Purchases may also be subject to import duties and taxes. These are levied once the items reach the specified destination, and the Buyer is responsible for any import duties incurred on purchases.

Rights of the Seller:
The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.
The Seller reserves the right to withdraw any goods from the Website at any time.
